1.הסכמה לתנאיםAgreement to these terms
תנאי שימוש אלה ("התנאים") הם הסכם מחייב בינכם לבין ישראל כהן, מפתח עצמאי מישראל ("אנחנו"), לגבי השימוש באפליקציה סרט גרם (SeretGram), באנדרואיד TV, בטלפון, בטאבלט וב-Windows, בגרסאותיה, בעדכוניה ובאתר שלה, ולגבי רכישת רישיון לשימוש בה (יחד: "השירות"). התקנה, הפעלה, רכישה או שימוש בשירות מהווים הסכמה לתנאים ולמדיניות הפרטיות. אם אינכם מסכימים, אל תשתמשו בשירות.
These Terms of Use (the "Terms") are a binding agreement between you and Israel Cohen, an independent developer in Israel ("we", "us"), covering the SeretGram, on Android TV, phones, tablets and Windows app, its versions and updates, its website, and the purchase of a licence to use it (together, the "Service"). By installing, activating, buying or using the Service you accept these Terms and the Privacy Policy. If you do not agree, do not use the Service.
כדי לרכוש רישיון עליכם להיות בני 18 לפחות ובעלי כשרות משפטית להתקשר בהסכם מחייב. אם אתם משתמשים בשירות מטעם ארגון, אתם מצהירים שאתם מוסמכים לחייב אותו בתנאים אלה.
To buy a licence you must be at least 18 and legally able to enter into a binding contract. If you use the Service on behalf of an organisation, you confirm you are authorised to bind it to these Terms.
2.התוכן והאחריות לוContent and your responsibility
סרט גרם מנגנת מדיה מצ'אטים, קבוצות וערוצים שבחשבון הטלגרם שלכם, ומרשימות טלוויזיה חיה ומדריכי שידורים שאתם מוסיפים. איננו מארחים, מעלים, מוכרים, מספקים או בודקים את התוכן הזה, ואין לנו שליטה עליו.
התוכן בערוצי טלגרם ובשרתי IPTV שייך לבעליו ולמפרסמיו ובאחריותם. "עוד לצפייה" רק מציעה ערוצים ציבוריים בטלגרם שמנוהלים בידי צדדים שלישיים; ההצטרפות אליהם היא בחירה שלכם, ואין בהצעה אישור או התחייבות לגבי התוכן שבהם.
אתם מתחייבים לצפות, להוריד ולשמור רק תוכן שמותר לכם לצפות בו, ולעמוד בחוק זכות יוצרים, התשס"ח-2007, ובדינים המקבילים במדינתכם. אל תוסיפו רשימות IPTV שאינכם מורשים להשתמש בהן.
על השימוש בטלגרם חלים תנאי השימוש של טלגרם. סרט גרם היא אפליקציה עצמאית שאינה קשורה לטלגרם.
בעל זכויות שסבור שתוכן מסוים מפר את זכויותיו צריך לפנות לגורם שמארח אותו (טלגרם או ספק השידור). נשמח לסייע ככל שנוכל: il90il90@gmail.com.
SeretGram plays media from chats, groups and channels in your Telegram account, and from live-TV playlists and programme guides you add. We do not host, upload, sell, provide or review that content, and we have no control over it.
Content in Telegram channels and on IPTV servers belongs to, and is the responsibility of, its owners and publishers. "More to watch" only suggests public Telegram channels run by third parties; joining them is your choice, and the suggestion is no endorsement of or promise about their content.
You agree to watch, download and keep only content you are allowed to watch, and to comply with the Israeli Copyright Law, 5768-2007 and equivalent laws where you live. Do not add IPTV playlists you are not authorised to use.
Your use of Telegram is governed by Telegram's Terms of Service. SeretGram is an independent app, not affiliated with Telegram.
A rights holder who believes some content infringes their rights should contact whoever hosts it (Telegram or the stream provider). We will gladly help where we can: il90il90@gmail.com.

3.רישיון השימושYour licence
בכפוף לתנאים ולתשלום, אנו מעניקים לכם רישיון אישי, מוגבל, שאינו בלעדי, שאינו ניתן להעברה ולהעברת משנה, להתקין את סרט גרם ולהשתמש בה במספר המכשירים שהרישיון שלכם מתיר, לשימושכם האישי או העסקי הפנימי.
האפליקציה מוענקת ברישיון ואינה נמכרת. כל הזכויות בה, לרבות זכויות יוצרים, סימני מסחר, קוד, עיצוב ותוכן, שמורות לנו ולבעלי הרישיונות שלנו. רכיבי קוד פתוח בתוכה כפופים לרישיונות שלהם.
אסור: לשתף, למכור, להשכיר או לפרסם מפתח רישיון; לעקוף, לנטרל או לזייף את מנגנון הרישוי או את בדיקות הרישיון; להפיץ את האפליקציה או גרסה משונה שלה; לבצע הנדסה הפוכה, פירוק או הידור לאחור של האפליקציה עצמה, אלא במידה שהדין מתיר זאת במפורש למרות הגבלה זו; ולהשתמש בשירות באופן בלתי חוקי או הפוגע באחרים.
Subject to these Terms and to payment, we grant you a personal, limited, non-exclusive, non-transferable and non-sublicensable licence to install and use SeretGram on the number of devices your licence allows, for your own personal or internal business use.
The app is licensed, not sold. All rights in it, including copyright, trademarks, code, design and content, belong to us and our licensors. Open-source components inside it are governed by their own licences.
You may not: share, sell, rent or publish a licence key; bypass, disable or forge the licensing mechanism or licence checks; distribute the app or a modified version of it; reverse-engineer, disassemble or decompile the app itself, except to the extent the law expressly allows despite this restriction; or use the Service unlawfully or to harm others.

ניסיון החינם מסתיים אוטומטית בתום 3 ימים, בלי חיוב. רישיון "לכל החיים" (Lifetime) הוא תשלום חד-פעמי, אינו פג ואינו דורש תשלום נוסף, וכולל את כל העדכונים, לכל משך הזמן שבו האפליקציה מופצת ונתמכת על ידינו (ראו "זמינות והפסקת השירות"). אין מנוי ואין חיוב חוזר.
על פי חוק מס ערך מוסף ופקודת מס הכנסה, נמסור קבלה או חשבונית ככל שהדין מחייב, לפי בקשה.
The price is in US dollars (USD), or in shekels (₪) for those paying in shekels, includes all charges, and is shown on the website and in the app before you buy. We may change prices in the future; a change never applies to a licence already paid for.
Payment is made outside the app through PayPal, which processes it under its own terms and privacy policy. We never receive or store your card or bank details. Currency-conversion or PayPal/bank fees may apply and are outside our control.
After paying, send us your payment receipt on Telegram (t.me/IsraelCohen) or by email and you will receive a personal licence key, usually the same day and at most within 3 business days. If you have not received a key by then, you may cancel for a full refund.
Each key activates the number of devices stated when you bought it (by default, one device). When you install from your phone on a TV, the TV tries to use the phone's key; if that key has reached its device limit, another key is needed.
The free trial ends automatically after 3 days, with no charge. A Lifetime licence is a one-time payment, does not expire, needs no further payment and includes every update, for as long as we distribute and support the app (see "Availability and discontinuation"). There is no subscription and no recurring charge.
We will issue a receipt or invoice where the law requires it, on request.
5.ביטול עסקה והחזריםCancellation and refunds
אנחנו רוצים שתהיו מרוצים. מדיניות הביטול שלנו נדיבה מהקבוע בחוק לגבי תוכנה, ואינה גורעת מזכות שמוקנית לכם בדין:
We want you to be happy with your purchase. Our cancellation policy is more generous than the law requires for software, and it does not take away any right you have under the law:
מפתח שטרם הופעל: ניתן לבטל את העסקה בתוך 14 ימים מיום התשלום ולקבל החזר מלא, ללא דמי ביטול.
מפתח שהופעל: אם האפליקציה אינה פועלת במכשיר שלכם כפי שהיא מתוארת באתר, ולא הצלחנו לפתור את הבעיה בתוך זמן סביר אחרי שפניתם אלינו בתוך 14 ימים מיום התשלום, תקבלו החזר מלא והמפתח יבוטל.
פגם או אי-אספקה: אם המפתח לא נמסר, אינו תקין, או שהשירות שונה מהותית ממה שתואר, תקבלו החזר מלא בכל עת, כמתחייב מחוק הגנת הצרכן, התשמ"א-1981.
מחוץ למקרים אלה, ובמידה שהדין מתיר, רישיון שהופעל אינו ניתן להחזר, שכן מדובר בתוכנה שנמסרה והופעלה.
בקשת ביטול שולחים בדוא"ל או בטלגרם, עם אישור התשלום. ההחזר מבוצע לאמצעי התשלום המקורי (PayPal) בתוך 14 ימים מקבלת הבקשה, והמפתח מבוטל.
צרכנים באיחוד האירופי ובבריטניה: אתם מבקשים שהתוכן הדיגיטלי יסופק מיד עם הפעלת המפתח, ומאשרים שזכות החרטה בת 14 הימים לפי הדין שם פוקעת עם ההפעלה; עדיין עומדות לכם הזכויות שבסעיף זה וזכויותיכם בגין אי-התאמה.
Key not yet activated: you may cancel within 14 days of payment for a full refund, with no cancellation fee.
Key activated: if the app does not work on your device as described on the website, and we could not fix the problem within a reasonable time after you contacted us within 14 days of payment, you get a full refund and the key is cancelled.
Defect or non-delivery: if the key was not delivered, does not work, or the Service is materially different from its description, you get a full refund at any time, as required by the Israeli Consumer Protection Law, 5741-1981.
Outside these cases, and to the extent the law allows, an activated licence is non-refundable, because it is software that has been delivered and activated.
Send cancellation requests by email or Telegram with your payment receipt. Refunds go back to the original payment method (PayPal) within 14 days of the request, and the key is cancelled.
Consumers in the EU and UK: you ask for the digital content to be supplied immediately when you activate the key, and you acknowledge that your 14-day right of withdrawal under local law ends on activation; the rights in this section and your rights for non-conformity still apply.
פתיחת מחלוקת או ביטול חיוב (chargeback) מול PayPal או חברת האשראי בלי לפנות אלינו קודם עלולה להביא לביטול המפתח. אנא פנו אלינו תחילה; כמעט תמיד נסדר זאת מהר.
Opening a dispute or chargeback with PayPal or your card issuer without contacting us first may lead to the key being cancelled. Please talk to us first; we can almost always sort it out quickly.
6.עדכונים, זמינות והפסקת השירותUpdates, availability and discontinuation
אנו רשאים לשפר, לשנות או להסיר תכונות. נשתדל לא לפגוע מהותית בתכונות המרכזיות שבגללן רכשתם רישיון לתקופה שטרם הסתיימה.
האפליקציה בודקת את הרישיון מול שרת הרישוי בערך פעמיים ביום, וממשיכה לפעול בלי חיבור עד 7 ימים. הצפייה עצמה דורשת חיבור לטלגרם או לשרתי השידור. רישיון שהשרת קובע שאינו תקף (למשל שבוטל) יפסיק לפעול במכשיר.
האפליקציה מסתמכת על שירותים של צדדים שלישיים (מפורטים במדיניות הפרטיות). איננו אחראים לזמינותם, לשינויים בהם או להפסקתם, אף שננסה למצוא חלופה סבירה.
אם נחליט להפסיק את האפליקציה לצמיתות, נודיע על כך באתר לפחות 60 ימים מראש. בעלי רישיון לתקופה שנותרו בו יותר מ-30 ימים יקבלו החזר יחסי. לבעלי רישיון לכל החיים ננקוט מאמץ סביר לספק גרסה אחרונה שאינה תלויה בבדיקת רישיון מקוונת; אם לא נוכל, ובתוך 24 החודשים הראשונים מהרכישה, יינתן החזר יחסי.
We may improve, change or remove features. We will try not to materially degrade the core features you bought a licence for while your licence period is still running.
The app checks the licence with the licensing server about twice a day and keeps working offline for up to 7 days. Watching itself needs a connection to Telegram or the stream servers. A licence the server reports as invalid (for example cancelled) stops working on the device.
The app relies on third-party services (listed in the Privacy Policy). We are not responsible for their availability, changes or shutdown, though we will try to find a reasonable alternative.
If we decide to discontinue the app permanently, we will announce it on the website at least 60 days in advance. Holders of a time-limited licence with more than 30 days left will get a pro-rata refund. For Lifetime licences we will make reasonable efforts to release a final version that does not depend on an online licence check; if we cannot, and the purchase was within the previous 24 months, a pro-rata refund will be given.
7.הגבלת אחריותDisclaimer of warranties
במידה המרבית המותרת בדין, השירות ניתן "כמות שהוא" (AS IS) ו"כפי שהוא זמין" (AS AVAILABLE). איננו מתחייבים שהשירות יפעל ללא תקלות או הפסקות, שיתאים לכל מכשיר, גרסת אנדרואיד או צורך, או שיהיה נקי משגיאות. אנו מסירים כל מצג או אחריות משתמעת, לרבות אחריות לסחירות, להתאמה למטרה מסוימת ולאי-הפרה. אין באמור כדי לגרוע מזכות צרכנית שאינה ניתנת להתניה על פי דין.
To the fullest extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE". We do not promise that it will run without faults or interruptions, suit every device, Android version or need, or be error-free. We disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Nothing here limits any consumer right that cannot be excluded by law.
8.הגבלת חבותLimitation of liability
במידה המרבית המותרת בדין: (א) לא נהיה אחראים לנזק עקיף, מיוחד, תוצאתי או עונשי, לאובדן רווחים, הכנסות, מוניטין, נתונים או זמן, הנובע מהשימוש בשירות או מחוסר היכולת להשתמש בו; ו-(ב) חבותנו הכוללת בגין כל עילה הקשורה לשירות לא תעלה על הסכום ששילמתם לנו עבור הרישיון ב-12 החודשים שקדמו לאירוע.
To the fullest extent permitted by law: (a) we are not liable for any indirect, special, consequential or punitive damages, or for loss of profits, revenue, goodwill, data or time, arising from your use of or inability to use the Service; and (b) our total liability for all claims relating to the Service will not exceed the amount you paid us for the licence in the 12 months before the event giving rise to the claim.
הגבלות אלה אינן חלות על נזק שנגרם בזדון או ברשלנות רבתי, על מוות או נזק גוף, או על כל חבות אחרת שאי אפשר להגביל על פי דין.
These limits do not apply to harm caused by our wilful misconduct or gross negligence, to death or personal injury, or to any other liability that cannot be limited by law.

You are responsible for backing up data that matters to you before using the Service.
9.שיפויIndemnity
אתם מתחייבים לשפות אותנו בגין כל תביעה, נזק או הוצאה סבירה (לרבות שכר טרחת עורך דין) שייגרמו לנו עקב שימוש שלכם בשירות בניגוד לתנאים אלה או לדין, או עקב פגיעה שלכם בזכויות של צד שלישי, ובלבד שנודיע לכם על התביעה בהקדם ונאפשר לכם להתגונן מפניה.
You agree to indemnify us against any claim, damage or reasonable expense (including legal fees) resulting from your use of the Service in breach of these Terms or the law, or from your infringement of a third party's rights, provided we notify you of the claim promptly and let you defend it.
10.השעיה וסיוםSuspension and termination
אתם רשאים להפסיק את השימוש בכל עת. אנו רשאים להשעות או לבטל מפתח רישיון אם הוא שותף, פורסם, נמכר הלאה או שימש מעבר למספר המכשירים המותר, אם נעשה ניסיון לעקוף את מנגנון הרישוי, אם בוצע ביטול חיוב שלא כדין, או אם נעשה שימוש בשירות באופן בלתי חוקי או המסכן אחרים. כשהדבר סביר, נפנה אליכם קודם ונאפשר לתקן את ההפרה. ביטול בשל הפרה אינו מזכה בהחזר, אלא אם הדין קובע אחרת.
You may stop using the Service at any time. We may suspend or cancel a licence key if it was shared, published, resold or used on more devices than allowed, if someone tried to bypass the licensing mechanism, after an unjustified chargeback, or if the Service is used unlawfully or in a way that endangers others. Where reasonable, we will contact you first and give you a chance to fix the breach. Cancellation for breach does not entitle you to a refund unless the law says otherwise.
הסעיפים שמטבעם נועדו לחול גם אחרי סיום ההסכם (לרבות קניין רוחני, הגבלת אחריות וחבות, שיפוי ודין חל) ימשיכו לחול.
Sections that by their nature should survive termination (including intellectual property, warranty and liability limits, indemnity and governing law) will survive.
11.דין חל וסמכות שיפוטGoverning law and disputes
על תנאים אלה יחולו דיני מדינת ישראל, בלי להחיל את כללי ברירת הדין שלה. סמכות השיפוט הבלעדית נתונה לבתי המשפט המוסמכים במחוז תל אביב-יפו, ואולם צרכנים רשאים לתבוע גם בבית המשפט המוסמך במקום מגוריהם, לרבות בבית משפט לתביעות קטנות. צרכנים מחוץ לישראל נהנים גם מכל הגנה שאינה ניתנת להתניה לפי דין מדינת מגוריהם.
These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. The competent courts of the Tel Aviv-Jaffa district have exclusive jurisdiction, except that consumers may also bring a claim in the competent court where they live, including a small-claims court. Consumers outside Israel also keep any protection that cannot be waived under the law of their country of residence.
לפני פנייה לערכאות, נשמח אם תפנו אלינו ונשתדל ליישב כל מחלוקת בתום לב בתוך 30 ימים.
Before going to court, please contact us; we will try in good faith to resolve any dispute within 30 days.
12.כלליGeneral
תנאים אלה, יחד עם מדיניות הפרטיות, הם ההסכם המלא בינינו לגבי השירות.
אם הוראה כלשהי תימצא בלתי תקפה, היא תוגבל במידה הנדרשת ויתר ההוראות יישארו בתוקף.
ויתור על זכות במקרה אחד אינו ויתור עליה במקרה אחר.
אינכם רשאים להעביר את זכויותיכם לפי תנאים אלה ללא הסכמתנו בכתב. אנו רשאים להעביר אותן לממשיך של הפעילות, בכפוף להודעה.
סרט גרם היא אפליקציה עצמאית. Android ו-Google הם סימני מסחר של Google LLC; PayPal הוא סימן מסחר של PayPal, Inc.; טלגרם הוא סימן מסחר של Telegram FZ-LLC. כל סימני המסחר שייכים לבעליהם, ואין באזכורם כדי לרמוז על שיוך, חסות או אישור.
התנאים מתפרסמים בעברית ובאנגלית ושני הנוסחים מחייבים במידה שווה; במקרה של סתירה יחול הנוסח המיטיב עם המשתמש. נודיע מראש על שינוי מהותי בתנאים, והוא לא יחול על רכישה שבוצעה לפניו.
These Terms, together with the Privacy Policy, are the entire agreement between us about the Service.
If any provision is found invalid, it will be limited to the extent necessary and the rest remains in force.
Waiving a right once does not waive it in any other case.
You may not transfer your rights under these Terms without our written consent. We may transfer them to a successor of the business, with notice.
SeretGram is an independent app. Android and Google are trademarks of Google LLC; PayPal is a trademark of PayPal, Inc.; Telegram is a trademark of Telegram FZ-LLC. All trademarks belong to their owners, and mentioning them does not imply affiliation, sponsorship or endorsement.
These Terms are published in Hebrew and English and both are equally binding; if they conflict, the version more favourable to the user applies. We will give advance notice of material changes, and a change never applies to a purchase made before it.
